1. Agreement to Terms

By accessing and using the Spectra mobile application (the "App") developed by Nullter, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Our App is a pharmacy restocking platform that connects licensed pharmacists in Kurdistan, Iraq with drug stores and suppliers. The service allows verified pharmacists to:

  • Browse and order pharmaceutical products
  • Track order status and receive updates
  • Manage pharmacy profiles
  • Receive order notifications and communications

3. Eligibility and Account Requirements

3.1 Professional Requirements

  • You must be a licensed pharmacist with valid credentials in Kurdistan, Iraq
  • You must be at least 18 years of age
  • You must provide valid pharmacy license documentation for verification

3.2 Account Verification

  • All accounts require verification of pharmacy license before activation
  • We reserve the right to request additional documentation to verify your professional status
  • False or misleading information may result in account termination

3.3 Account Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to notify us immediately of any unauthorized use of your account
  • You are responsible for all activities that occur under your account

4. Use of the Service

4.1 Permitted Use

The App is exclusively for:

  • Licensed pharmacists conducting legitimate business
  • Ordering pharmaceutical products for licensed pharmacy operations
  • Professional pharmaceutical restocking purposes

4.2 Prohibited Use

You may not:

  • Use the App for any illegal or unauthorized purposes
  • Share your account with unlicensed individuals
  • Order products for personal use or resale outside of your licensed pharmacy
  • Interfere with or disrupt the App's functionality
  • Attempt to gain unauthorized access to our systems
  • Use the App if you are under 18 years of age

5. Orders and Payment

5.1 Order Process

  • All orders are subject to product availability
  • Orders must be placed by verified, licensed pharmacists
  • We reserve the right to cancel orders at our discretion

5.2 Payment Terms

  • Payment is cash on delivery (COD) only
  • Payment is due upon delivery of products
  • All payments are in Iraqi Dinar unless otherwise specified

5.3 Pricing

  • Prices are set by individual drug stores and suppliers
  • Prices may change without notice
  • We earn revenue through commissions from drug stores, not from pharmacies

6. Our Revenue Model

  • The App is free for pharmacists to use
  • We earn revenue by taking a percentage commission from drug stores and suppliers
  • Pharmacists are not charged any fees for using the service

7. Order Tracking and Communications

  • You can track your order status through the App
  • We may send notifications about order updates, changes, and delivery status
  • Communication regarding orders may include notes and status changes

8. Geographic Limitations

This service operates exclusively within Kurdistan, Iraq. Orders cannot be placed for delivery outside this region.

9. Intellectual Property

  • The App and its content are owned by Nullter
  • You may not copy, modify, or distribute any part of the App without permission
  • All trademarks and logos are the property of their respective owners

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

11. Disclaimers

11.1 Service Availability

  • We do not guarantee uninterrupted access to the App
  • The App may be temporarily unavailable due to maintenance or technical issues

11.2 Product Information

  • Product information is provided by suppliers and may not always be accurate
  • We are not responsible for product quality or availability
  • All transactions are between pharmacists and drug stores

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

13. Indemnification

You agree to indemnify and hold harmless Nullter from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

14. Termination

14.1 Termination by You

  • You may delete your account at any time
  • Account deletion is subject to our data retention policy

14.2 Termination by Us

We may terminate your account if:

  • You violate these Terms
  • You provide false information during verification
  • You engage in fraudulent or illegal activity
  • You are no longer a licensed pharmacist

15. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of Kurdistan Region, Iraq. Any disputes shall be resolved in the courts of Kurdistan Region, Iraq.

18. Severability
